Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Flore mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you ("End User") and Vaunted Labs LLC ("Company," "we," "us," or "our"), a Delaware limited liability company (EIN: 32-0843694, DUNS: 144964695) with its principal office at 254 Chapman Rd, Ste 208 #26689, Newark, Delaware 19702, United States. These Terms are between you and Vaunted Labs LLC only, and not with Apple Inc. ("Apple") or Google LLC ("Google"). Apple and Google are not parties to these Terms.

2. Description of Service

Flore is an AI-powered hormonal health application designed for women. The App provides AI meal scanning to analyze the hormonal impact of food, comprehensive hormonal cycle tracking, personalized anti-inflammatory recipes, and customized programs based on each user's metabolic profile. The App is intended for educational purposes and does not replace medical advice.

3. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you must have parental or guardian consent to use the App. The App is rated 4+ on the Apple App Store.

4. License Grant and Scope

Subject to your compliance with these Terms, Vaunted Labs LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, as permitted by the Apple App Store and Google Play Store Terms of Service.

5. Subscription Terms

5.1 Plans

Flore offers the following subscription plans:

• Monthly Plan: 13.99€ per month
• Annual Plan: 59.99€ per year (4.99€/month)

A free trial may be available for new users. The duration and terms of the free trial will be displayed at the time of sign-up. If a free trial is offered, the price that will be charged after the trial ends will be clearly stated before you subscribe.

5.2 Auto-Renewal and Payment

5.3 Cancellation

You may cancel your subscription at any time through your Apple ID Account Settings or Google Play Store settings. Cancellation will take effect at the end of your current billing period. You will retain access to premium features until the end of the paid period. No refunds will be issued for the current billing cycle.

5.4 Billing

All billing is managed by Apple or Google through their respective stores. We do not store or process your payment information directly.

6. Health Disclaimer

Flore is an educational application and does not provide medical advice, diagnosis, or treatment. The information provided by the App, including AI-generated meal analyses and hormonal recommendations, is for informational and educational purposes only. Always consult a qualified healthcare professional before making changes to your diet, exercise routine, or health management plan.

7. User Content

You retain ownership of all photos and content you upload to the App. By uploading content, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the App's AI analysis and recommendation services.

8. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Upload inappropriate, offensive, or harmful content.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Use automated tools or bots to access the App.
• Resell, redistribute, or sublicense access to the App.

9. Intellectual Property

The App, including its design, features, code, AI models, branding, recipes, and all related intellectual property, is owned by Vaunted Labs LLC and is protected by applicable intellectual property laws.

10. Maintenance and Support

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not guarantee that AI-generated analyses will be medically accurate or suitable for treating any specific health condition. The App is intended for educational and informational purposes only.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VAUNTED LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES RESULTING FROM YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

13. Indemnification

You agree to indemnify and hold harmless Vaunted Labs LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the App or violation of these Terms.

14. Third-Party Terms

You must comply with applicable third-party terms of agreement when using the App. The App uses third-party services including Supabase, Firebase, PostHog, Tenjin, RevenueCat, and Superwall. Your use of the App is also subject to the terms and privacy policies of these third-party services.

15. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of the App after such changes constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States. Any disputes shall be resolved in the state or federal courts located in Delaware.

18. Apple as Third-Party Beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
